ATOP Corporation offers a diverse portfolio of products that are manufactured with inputs provided by hundreds of suppliers, all of which make up ATOP Corporation’s global supply chain. At ATOP Corporation, we strive to act in an environmentally and socially responsible manner, and in compliance with all applicable laws and regulations, while meeting the needs of our customers.
On August 22, 2012, the U.S. Securities and Exchange Commission (SEC) approved the final rule regarding the sourcing of “conflict minerals” (i.e., tantalum, tin, tungsten, and gold, known collectively as “3TG”) under Section 1502 of the Dodd-Frank Wall Street Reform and Consumer Protection Act. Under the rule, ATOP Corporation , must report the presence of conflict minerals originating in the Democratic Republic of the Congo (DRC) or adjoining countries (collectively, the “conflict region”) in the products they manufacture or contract to manufacture.
ATOP Corporation is concerned that the trade of conflict minerals mined in the conflict region may be fueling human rights atrocities in the region. These minerals are widely used in our products and the end markets served by ATOP Corporation As a result, we support the actions of governments and organizations to increase supply chain transparency and enable companies to source conflict-free minerals.
ATOP Corporation committed to sourcing materials from suppliers that share our values around human rights, ethics, and environmental responsibility. We have initiated a comprehensive process to meet these regulatory requirements, taking steps to increase our supply chain due-diligence measures and internal controls for the covered minerals.
ATOP Corporation also expects its suppliers to develop internal conflict minerals policies, duediligence frameworks, and management systems that are designed to identify and ultimately eliminate from use in products sold to Coherent any conflict minerals that are known to come from sources funding armed groups in the conflict region. To support these efforts, ATOP Corporation fully expects our suppliers to cooperate with us, provide information, and promptly implement corrective actions identified and requested by us.
In addition, ATOP Corporation has broadened its Responsible Minerals program to include cobalt and mica from CY2022, and in geographies beyond the conflict region that are driving an increased demand for greater accountability and transparency in global mineral supply chains. We use the guidelines and framework of the Organization for Economic Cooperation and Development (OECD), including all risks identified in Annex II of the OECD guidance, and apply 3TG management systems as the infrastructure and exercise due diligence for cobalt and mica throughout the supply chain. We require our supply chain to source 3TG, cobalt, and mica from smelters and refiners that are conformant to the Responsible Minerals Assurance Process or other cross-recognized standard. Smelters used are required to bevalidated by an independent third-party audit program.
ATOP Corporation will proactively work with suppliers to further develop their capabilities in responsible minerals due diligence to ensure alignment to our supplier requirements. Suppliers that do not reasonably comply with our Responsible Minerals Policy will be reviewed by ATOP Corporation to assess whether we will conduct business with those suppliers in the future.
